Messaging Policy

1. Overview

This Messaging Policy governs the use of SMS, MMS, and chat messaging through the APB Direct Connect platform and related Critical Reach services. By using our messaging features, you agree to comply with this policy.

2. Consent Requirements

Consent is required before sending messages to any recipient. Users must document and retain proof of consent. Two exceptions apply:

  • Individual-initiated contact (the recipient contacts you first)
  • Informational messages (appointment reminders, delivery receipts, service notifications)

3. Opt-Out Requirements

All initial messages must include opt-out instructions: “Reply STOP to unsubscribe.” Opt-out requests must be honored immediately. Recipients who opt out must not receive further messages unless they re-consent.

4. Prohibited Content

The following content is prohibited in all messages sent through our platform:

  • Illegal content of any kind
  • Cannabis or CBD products
  • Prescription drug promotions
  • Hate speech or discriminatory content
  • Malware, phishing, or deceptive links
  • Content that violates any applicable law or regulation

5. Age-Gated Content

Content related to alcohol, firearms, gambling, or tobacco requires age verification of all recipients before sending. Users are responsible for ensuring compliance with age-gating requirements.

6. Anti-Evasion

Users must not attempt to circumvent content filtering or carrier policies through misspelling, character substitution, snowshoeing (distributing messages across multiple numbers to avoid detection), or any other evasion technique.

7. Enforcement

Violations of this policy may result in suspension or permanent removal of messaging privileges. Critical Reach reserves the right to monitor messages for compliance and to take immediate action against accounts that violate this policy or applicable law.

8. SMS/MMS Privacy

Phone numbers and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for complete data handling practices.
